Distance Sales Agreement

1. Parties

BUYER: The natural or legal person purchasing the service.

2. Subject Matter of the Agreement

This agreement sets out the rights and obligations of the parties regarding the sale and performance of the software development, licensing, maintenance and support services ordered by the BUYER electronically, in accordance with Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

3. Service Details and Fee

The type, scope, duration and total fee of the service are specified in the written quotation and/or project agreement presented to the BUYER before the order. Prices are exclusive of VAT; VAT is invoiced separately at the statutory rate.

4. Payment Terms

• Payments may be made by bank transfer (wire/EFT) or credit card
• Credit card transactions are processed through the iyzico infrastructure with 3D Secure
• Card details are neither seen nor stored by the SELLER
• For project-based work, payment is made in the stages specified in the quotation

5. Performance Period

The performance period of the service follows the schedule specified in the quotation or project agreement and starts once the BUYER has provided the necessary information, documents and access. Delays attributable to the BUYER are added to the performance period.

6. Right of Withdrawal

The BUYER may exercise the right of withdrawal within 14 days, without giving any reason, before performance of the service has begun. The notice of withdrawal is submitted to the SELLER in writing or via a durable medium.

• The right of withdrawal cannot be exercised for services whose performance has begun with the BUYER's consent
• There is no right of withdrawal for software prepared specifically for the individual according to the BUYER's requests
• The right of withdrawal cannot be exercised for services performed instantly in electronic form

7. Dispute Resolution

For disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence have jurisdiction, within the monetary limits announced by the Ministry of Trade. In commercial sales, the courts and enforcement offices of Balıkesir have jurisdiction.
